The following terms and conditions (“Terms and Conditions”) form a binding agreement (this “Agreement”) between you and MDNS Enterprises, LLC, a Limited Liability Company operating out of the State of California (“Stronger”). Stronger may modify, amend, supplement and replace these Terms and Conditions at any time without providing you with advance notice. Your continued use of this Site after any change means you have accepted the changed Terms and Conditions.

  1. Copyright.

    1. All materials created by Stronger on the Site are protected by United States copyright laws as original works. The absence of a registered copyright symbol does not mean that such materials are not protected as belonging to  Stronger. 

  1. Links to Third Party Websites.

    1. This Site may contain links to third party websites. All such linked sites, materials and pages are not under the control of Stronger and Stronger is not responsible for the content contained in any linked website nor for any losses or damages you may incur as a result of the use of any third party website. Stronger accepts no liability for any errors or omissions contained in third party websites. These links are provided to improve your use of this Site, enable you to connect with Stronger on various platforms, help Stronger offer the easiest services for you and conduct transactions. 

  1. Use License.

    1. If Stronger has materials on the Site which you can download, permission is granted to download copies of the materials for personal, non-commercial viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;

  1. use the materials for any commercial purpose or for any public display (commercial or non-commercial);

  1. transfer the materials to another person or “mirror” the materials on any other server.

    1. Our refund policy for any of the services or products sold on the Site is as follows: generally, all sales are non-refundable. Sales of membership and class packages are final, unless there is an exceptional circumstance.

That being said, any information and services provided on or through the Site is for informational and educational purposes only. What we share is the opinion and perspective of Stronger.  The information and education is not intended or implied to supplement or replace professional advice. Before taking any action, please make sure you consult with a professional.

    1. We make no guarantees about any particular results or benefits that you’ll get from our Site, our products or services. We will do everything to give you the tools to succeed, but we make no guarantees. We cannot be any more clear about this: we make no promises regarding results and make no guarantees whatsoever.

    1. Stronger may revise these Terms and Conditions for its Site at any time without notice. By continuing to use the Site after Stronger modifies this Agreement, you are agreeing to be bound by the updated version of this Agreement.

  1. Limitation of Liability.

In no event shall Stronger or its affiliates be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to view or use the materials or content on the Site, even if Stronger has been notified orally or in writing of the possibility of such damage. 

  1. Choice of Laws and Venue.

    1. The parties agree to irrevocably submit all claims relating to Stronger’s Site to the exclusive jurisdiction of the courts of the State of California without regard to its conflict of law provisions.

  1. Indemnity.

    1. As a condition of your use of this Site, you indemnify Stronger and its directors and affiliates from and against any and all liabilities, expenses (including legal fees) and damages arising out of claims resulting or arising from your use of this Site.

These Terms and Conditions and any other legal notices, policies and guidelines of Stronger linked to these Terms and Conditions or contained on this Site constitute the entire agreement between you and Stronger relating to your use of this Site and supersede any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter. This Agreement may not be amended or modified except by Stronger. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, that portion or provision shall be enforced to the maximum extent permissible so as to effectuate the intent of the parties as reflected by that provision, and the remainder of these Terms and Conditions shall continue in full force and effect. Failure by Stronger to enforce or exercise any provision of these Terms and Conditions shall not constitute a waiver of that right. Paragraph headings are for reference only.

PRIVACY POLICY

Stronger understands how important your privacy is. This privacy policy (the “Privacy Policy”) sets out the privacy policies and practices for MDNS Enterprises, LLC and its subsidiaries and affiliates (collectively, “ Stronger”) with respect to how Stronger collects your personal information. It also describes how Stronger maintains, uses, and discloses personal information. This Privacy Policy applies to information collected from you by Stronger via the Site. This Privacy Policy also sets out how you can access certain information that Stronger may collect about you.  

In this Privacy Policy, personal information means information about an individual whose identity is apparent or can be reasonably ascertained from the information as further defined under applicable privacy laws (“Personal Information”).

Please note that the Site may contain links to other third-party websites that are not controlled or operated by Stronger. All of these third parties are listed in section 4.4 of this Agreement. This Privacy Policy does not apply to such third-party websites, and Stronger is not responsible for the content of such third-party websites or the privacy practices of such third parties. Stronger encourages you to request and review the privacy policies of any third parties upon disclosing your Personal Information to such parties or when visiting such third-party websites.

  1. Consent of Collection of Information.

    1. By submitting Personal Information to Stronger and its Site or any of its service providers, you agree and consent to the collection of your Personal Information and consent to the use, disclosure and transfer of your Personal Information in accordance with the provisions of this Privacy Policy. You may always refuse or withdraw your consent by contacting Stronger at hello@strongerfitnessstudio.com. You understand that if you withdraw your consent, Stronger may not be able to continue to offer its services and provide its information to you.  

  1. Children Under 18.

    1. The Site is not intended for children under eighteen (18) years of age. No one under age 18 may provide any Personal Information to or on the Site. Stronger does not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on the Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If Stronger learns we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information.   1. Revisions to this Privacy Policy.

Stronger reserves the right, in Stronger’s sole discretion, to change, modify, add or remove portions of this Privacy Policy at any time and from time to time, without prior notice to you. Stronger will treat your continued use of the Site following such revision as your acceptance of the revised terms. All revisions will be posted to the Site and will apply to any Personal Information collected on or after the date posted. Stronger will obtain the necessary consents required under applicable privacy laws if it seeks to collect, use or disclose your Personal Information for purposes other than those to which consent has been obtained, unless otherwise required or permitted by law.

  1. What Personal Information does Stronger collect and how is it processed? 

    1. Stronger may directly collect your name, address, phone number and email address. There may be other information you provide but that will not be collected by Stronger and instead will be collected by the third parties Stronger works with as outlined in 4.4.

    1. We may send you a newsletter or other promotional materials through email. We will only contact you through our newsletter for promotional or informational purposes. Subscribing to our newsletters is optional and you will always be able to unsubscribe. 

  1. Phone Number.

    1. We may collect your phone number and we may contact you via phone to contact you or if we feel there is information which would be beneficial to share with you. In accordance with everything outlined in this Privacy Policy, if you do not want to be reached by phone, you can ask us not to contact you via phone or you can choose not to share your phone number.

  1. Third Parties.

    1. Stronger may work with third party applications in order to provide you with the best services on the Site. These organizations may collect Personal Information from you in order to provide you with the services, including your name and contact information. Specifically, the third parties Stronger may work with on the Site are listed below. We’ve included links to their privacy policies to ensure you are comfortable using them.

  1. How will Stronger use your Personal Information?

    1. Your Personal Information will be used to provide you with promotional and informative materials and offers and deliver the products and services you can purchase or subscribe to from the Site. Specifically: 

      1. Your credit card information will not be kept by Stronger but instead by one of the third parties listed in section 4.4 above;

      2. Your name and e-mail address are collected but will not actually be stored on the Site. Any information captured will be processed through third party websites in section 4.4 above; 

      3. Your phone number may be used to contact you via phone if there is information we would like to share which we feel would benefit you;

      4. If you subscribe to our newsletter your Personal Information will be used to send the newsletter to you;

      5. If we send you the Newsletter for marketing purposes, we will send you emails about promotions, special events and other information. You can opt not to receive these emails from us by either clicking “unsubscribe” at the bottom of the email when you receive it or by sending an email that includes your email address and a request that you not receive our promotional emails;

      6. We may use your Personal Information to respond when you submit a question or suggestion to us, or when you request assistance regarding a service or product you purchased.

      7. We may share your information if we believe in good faith that disclosure of your information is required to protect your safety or the safety of others, to investigate a fraud, or to respond to a government, judicial or other legal request or to comply with the law;

  1. Storing Your Personal Information.

    1. Stronger’s web service may store your Personal Information when you interact with the Site. Stronger will be happy to delete any of your Personal Information that it holds upon a written request made by you. Your Personal Information will be safely disposed of by Stronger.

    1. Your phone number will be kept in the phone or contacts database of Stronger and associates. Wherever it is stored, it will always be protected with a password and will never be shared with third parties without your permission.

  1. We Play by The Rules.

    1. The Site and Stronger abide by all relevant United States federal and State privacy laws in all aspects of our operations. This Privacy Policy is also compliant with GDPR and CCPA regulations.   1. Do Not Track Signals.

    1. Stronger currently does not recognize or respond to browser-initiated Do Not Track (DNT) signals, as the Internet industry is currently still working on Do Not Track standards and there is no accepted standard on how to respond to such signals.

  1. Analytics.  

    1. The Site keeps the following information from your visits to our webpage:

  1. Visitor information to improve our customer engagement which tells us where and when people visit the Site and how long they stay there; and 

  1. IP information for website and server security.

  1. Cookies.

    1. The Site uses ‘cookies’ to keep a record of the number of times you’ve visited the Site and how you interacted with the Site during each visit. In addition to this, the Site also uses cookies which are not absolutely essential for your use of the Site. Your continued use of the Site serves as consent for these cookies.

  1. Choice of Laws and Venue.

    1. This Privacy Policy and the use of the Site are governed by the laws of the United States and the State of California. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of California. If a dispute arises, we agree to first resolve it through binding arbitration to take place in the State of California.

    1. By choosing to provide Stronger with your Personal Information you are consenting to its collection, use and disclosure in accordance with the principles outlined in this Privacy Policy. If you are under the age of 18, you must not provide any Personal Information to us without the consent of your parent or guardian, or as otherwise provided for by applicable law.

Please refer to the third parties’ privacy policies, of which links have been provided above, for clarification on how your transaction and Personal Information will be handled. Stronger makes no promises, warranties or representations about the manner in which your Personal Information is handled by third parties and bears no liability whatsoever for their use of them.

    1. Stronger will ask you to verify your identity when you contact us  or submit a request regarding your Personal Information. Stronger will ask you to provide sufficient information that allows us to reasonably verify that you are the person who we collected Personal Information about.  

  1. The Internet Can Be Sketch.

    1. The internet is, by its nature, inherently open and subject to interception of information. We cannot guarantee that the information you provide to Stronger over the internet or otherwise will not be intercepted by third parties while it is being communicated by means that are outside of Stronger’s control.

WAIVER AGREEMENT

Why You’re Reading This Document

The purpose of this release and waiver (the “Waiver”) is to openly communicate the risks of practicing lagree together, either in person or online, and have you release Stronger of any liability. Please be aware that if you do not sign this Waiver and agree to its terms, you will not be permitted to participate in any classes. 

If you are under the Age of Majority in the State of California (18 years old), your legal guardian must also sign this Waiver on your behalf. 

 

PLEASE READ CAREFULLY, UNDERSTAND FULLY, AND ASK QUESTIONS IF ANYTHING IS UNCLEAR. WE ARE HERE TO SUPPORT YOU. MAKE SURE YOU UNDERSTAND THIS WAIVER.  BY SIGNING THIS YOU AGREE YOU ARE SIGNING AWAY YOUR LEGAL RIGHTS AND YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS WAIVER.

  1. Parties.

    1. We will refer to MDNS Enterprises, LLC, a limited liability company based in the State of California, as “Stronger”, “us”, “we”  or “our”, and we’ll refer to you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Waiver, as “you” or “your”.

  1. The Activities.

    1. You may participate, in person or online, in lagree and exercise classes, sessions, workshops and more with Stronger. We offer levels of strong and motivating lagree classes, all of which may involve but are not limited to the following (“Activities”):

      1. Flexibility training in the form of lagree positions, body weight exercises, use of lagree equipment for stretching and resistance exercises, strength exercises, mobility, range of motion exercises, breathing exercises, and relaxation exercises. 

      2. The constant in all of these classes is that the Activities involve moving in full ranges of motion, strength training, and postural training. The Activities may involve receiving adjustments from instructors, so please advise in advance if you do not want adjustments. 

      3. The Activities also apply to any classes made available for online streaming and participation, both live or recorded, or that take place outside of Stronger’s facilities, including outdoors. We need you to acknowledge that you are responsible for the safe facilitation of the Activities happening outside of our facilities. 

      4. Equipment. In the course of the Activities, you will use a variety of equipment, which may include but is not limited to:  megaformer, weights, balance bar, bungee cord, balance disk, and pilates ring (the “Equipment”). Please do not use any equipment not instructed by Stronger.

  1. Inherent Risks.

    1. You understand that participating in the Activities poses inherent risks, some more obvious or serious than others. These risks can result in serious harm and injuries that could change your quality of life and, in very rare and extreme circumstances, may even result in death. 

    2. Injuries include but are not limited to things like muscle tears, strains, rhabdomyolysis and other musculoskeletal injuries, sprains, fractures, broken bones, cardiovascular complications, high blood pressure, dehydration, dizziness, fainting, and hearing loss. 

    3. Exposure to and contraction of COVID-19 or other communicable diseases passed on via other participants and use of shared space, surfaces, or Equipment. 

    4. Additional risks of Activities for pregnant or post-natal women to the health of your fetus and your body, including but not limited to pregnancy loss, low birth weight, early delivery and postpartum complications. 

    5. Additional risks posed by participating in the Activities online, as there is no in-person supervision or space provided for you, and you will therefore need to ensure the safety of the Activities, using your judgment how to best practice them, not pushing yourself too far or attempting anything you feel unsure how to perform.

    6. Other risks posed for Activities performed outdoors, such as tripping or collision with human or natural elements, sun exposure, dehydration, insects, exposure to infections, diseases, pollutants and other environmental factors. You understand and agree it is your responsibility to ensure a safe space and environment to perform the Activities. 

  1. Affirmation of Health.

    1. By participating in any Activities with Stronger, you affirm that you have sought medical advice regarding your fitness or are certain of your ability to practice lagree. If you have any pre-existing medical conditions (e.g. asthma, diabetes, heart disease), physical injuries, weakness, are pregnant, post-natal or post-surgery, you should consult with your doctor first before engaging in the Activities. Please communicate and inform us IMMEDIATELY if at any point you do not feel well during the Activities. 

  1. COVID-19 & Infectious Disease.

    1. If at any point within 14 days prior to participating in any of the Activities, you have suffered from symptoms of a communicable disease (including but not limited to fever, chills, cough, shortness of breath, or sore throat), been in close contact with someone with a known or suspected case or in a hot spot area, or else are uncertain of your health or risk of transmission, you agree not to join or participate in the Activities and you should consult with your doctor. You agree to comply with all measures and policies implemented by Stronger and applicable public health guidelines as updated, including but not limited to wearing masks, personal hygiene and social distancing, and allowing your temperature to be checked before arriving to class.

  1. Consent to Cooperate with Contact Tracing.

    1. You understand and agree that Stronger may disclose your personal information to the relevant authorities as required by law and policies related to the containment of COVID-19 through contact tracing or for other lawful purposes. 

  1. Voluntary Assumption of Risk.

    1. You have read this Waiver and understand the risks of participating in the Activities with Stronger. Your signature below, electronic signature or clicking 'I Agree’, and your participation in the classes with Stronger illustrates your voluntary engagement and assumption of the risks of the Activities.   

  1. Release, Waiver and Indemnity.

    1. You hereby release, hold harmless, indemnify and waive any claims against MDNS Enterprises, LLC, its members, directors, officers, contractors, employees, volunteers, agents, executors, administrators, successors, family members and assigns (the “Released Parties”) from any liability and damages arising from death or personal injuries, including the contraction of COVID-19 or other communicable diseases or related to premises liability, however caused including as a result of Stronger’s negligence, during your participation in the Activities with Stronger. You are releasing the Released Parties at your own risk and you agree to forfeit any and all forms of legal recourse which may be available to you, including but not limited to any form of damages, as a result of your participation in the Activities. You agree that these provisions above apply to you, your family, heirs, executors or anyone else who may be able to bring a legal action on your behalf in the future.   

  1. Media Release.

    1. We think you’re awesome and want to show you off! By participating in the Activities at Stronger, you agree to grant us the irrevocable right to use your image, likeness, photos, video content, audio recordings captured of you on the premises or that you share with us online (via your own or others posting of you) as part of our online streaming, marketing and sales throughout the world and in perpetuity. You also release us from all claims you may have relating to such use. Please let us know if you ever want us to stop using an image of you.

  1. Continued Agreement.

    1. Agreement to this Waiver will act as your continued agreement to all ensuing classes, sessions and workshops whether in person, online, or via video conferencing tool. 

  2. Valuables.

    1. You agree that we are not responsible for the loss or damage of any personal property you bring or leave with Stronger. 

  1. General Legal Provisions.

    1. Choice of Laws and Venue. This Waiver will be governed exclusively by the laws of the State of California. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of California. Severability. If any provisions of this Waiver are invalid or unenforceable, the other provisions in the Waiver will remain in full force and effect. Entire Agreement. This Waiver constitutes the entire agreement between the parties and replaces any prior agreements. Headings. The headings used in this Waiver are for stylistic purposes only and none of the content in the headings are intended to be legally binding. Online Agreement. We agree that this Waiver may be signed electronically or agreed to by having you click “I Agree”, the effect of which will be the same as signing by hand and the intention of which is that both parties desire to be bound by all the terms of this Waiver. 

You agree that you have read this Waiver and fully understand its contents and voluntarily agree to be bound to all of its terms.
